The 32-year-old actress is believed to have signed legal documents to terminate her marriage with the French journalist - with whom she shares three-year-old daughter Rose - in NY, and the news reportedly left Romain and his lawyer "stunned" as they were in the middle of private negotiations at the time.
The New York Post reports that the actress' attorney Judith Poller has issued divorce papers to Dauriac's lawyer Harold Mayerson. According to Page Six, both Johansson and Dauriac are after primary custody of the two-year-old, with Dauriac wanting to move to France.
Dauriac's lawyer told media his client was surprised by the custody request, reportedly claiming he was the "primary parent" for the child while Johansson was busy making movies, and that he meant to take his daughter to live with him back in France.
"It will be an interesting process", he added.
Johansson and Dauriac were first linked to each other in 2012.

Romain reportedly plans to fight for custody of Rose, which could set up an ugly court battle. She previously moved to New Zealand while shooting her upcoming film, "Ghost in the Shell". Earlier this year, it was confirmed that the two separated in summer 2016.
"The kid was bouncing back and forth. It can't work because [Johansson] travels so much", the insider said.
Johansson's representatives did not immediately respond to a request for comment.
